The man threw his sick wife back to her mother’s house and was sentenced to pay medical expenses of 28,000 yuan.

After his wife was mentally abnormal, Wenmou, a man from Wenzhou, Zhejiang Province, was unwilling to pay medical expenses, and sent his wife back to her family and sued for divorce. In this regard, the father-in-law Chen Damou, as the legal representative of his daughter Chen Mou, sued the son-in-law Wen Mou and asked him to pay his daughter’s medical expenses.

On October 10th, The Paper learned from Pingyang County People’s Court in Wenzhou that the court recently ruled that Wenmou Wenmou paid 28,000 yuan for Chen Mou’s medical expenses, and the judgment has come into effect.

In August, 2016, Chen Mou and Wenmou got engaged shortly after their blind date, and held a wedding in September of the same year. In 2017, Chen Mou had an ectopic pregnancy, and the doctor told her that it was difficult to get pregnant again. Chen Mou was very depressed, and Wenmou took him to the hospital for examination. The doctor diagnosed Chen Mou with hysterical mental disorder. Soon, Wenmou brought his wife Chen Mou back to her family, and never appeared again.

In March this year, Wenmou filed a divorce lawsuit with the court on the grounds that "Chen Mou is mentally handicapped at present, and as a person with limited capacity for civil conduct, both parties cannot continue to live together as husband and wife". The court held that the reason did not belong to the statutory granting of divorce, so it was not supported according to law.

Father-in-law Chen Damou was very angry at the son-in-law for not only ignoring and not paying any medical expenses during his daughter’s illness, but also proposing a divorce. Later, as the legal representative of her daughter, she sued Wen in Pingyang Court in the name of Chen Mou, demanding that she pay 28,000 yuan for medical expenses.

The court held that husband and wife have the obligation to support each other. When one party fails to perform the maintenance obligation, the other party has the right to demand the maintenance fee. As husband and wife, the defendant and the defendant should take care of each other. Now Chen Mou suffers from hysterical mental disorder and lacks the ability to work. Wen should fulfill the legal obligation of support for Chen Mou. Chen Mou’s family expenses such as medical expenses and transportation expenses should be borne by Wen. In the end, the court ruled that Wen paid Chen Mou 28,000 yuan for medical treatment. (Reporter Ge Rongjin)
